Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the provision of services by Spinx Property Maintenance & Repairs (Pty) Ltd ("we," "our," "us") to our clients ("you," "your"). By engaging our services, you agree to these Terms.

2. Scope of Services

We offer a comprehensive range of property maintenance and repair services, including but not limited to:

  • General Property Services: Minor building works, renovations, bricklaying, plastering, tiling, painting, waterproofing, drywall partitioning, carpentry, aluminium works, landscaping, paving, pest control, cleaning, and handyman services.
  • Electrical Services: Electrical installations and repairs, complete electrical system installations, UPS and generator installations, transformer installations, and specialised electrical services.
  • Plumbing Services: Installation and repair of plumbing systems.
  • Heavy Equipment Services: Maintenance and repair of generators, UPS, MV switchgears, and transformers.
  • Transport Services: Waste management, diesel delivery, office relocations, and rubble removal.
  • Supply Services: Provision of furniture, fittings, electrical appliances, plumbing and sanitaryware, building materials, and other related products​​.

3. Service Execution and Limitations

3.1 Warranty and Workmanship:

  • We provide a 3-month warranty on all workmanship. If any defects in workmanship are identified within this period, we will rectify the issue at no additional cost.
  • For parts, spares, furniture, or fixtures supplied by us, the warranty period is typically 12 months, but it is subject to the manufacturer's warranty. The manufacturer's warranty is transferred to the customer upon installation or delivery, and we carry no further liability beyond this point. Customers are advised to familiarise themselves with the manufacturer's warranty terms and conditions.

    3.2 Manufacturer’s Warranty and Liability:

    • Our liability is limited to the replacement or repair of defective parts within the warranty period specified by the manufacturer. We do not assume responsibility for any direct, indirect, incidental, or consequential damages arising from defects in parts, spares, furniture, or fixtures supplied by us.
    • In the event of a claim, it is the customer’s responsibility to contact the manufacturer directly. We will assist in facilitating the claim process but will not be held liable for the manufacturer’s decisions or any delays in the resolution of the claim.
    • The customer agrees to indemnify and hold us harmless from any claims, damages, or expenses arising from defects in parts, spares, furniture, or fixtures that are covered by the manufacturer’s warranty.

3.3 Service Limitations:

  • Our services are provided based on the information and access given to us. We are not responsible for any issues that were not apparent or disclosed at the time of service.
  • If we install a new part (e.g., for an air conditioner) and other issues become visible once the part is functioning, we are not liable for those additional issues. We will, however, provide an assessment and quote for any additional repairs needed.

3.4 Risk Management:

  • We follow strict safety and risk management protocols to protect our staff and clients. However, we cannot be held liable for any unforeseen accidents or damages that occur due to factors beyond our control​​.

4. Client Responsibilities

4.1 Accurate Information:

  • You must provide accurate and complete information regarding the services needed and any known issues with your property or equipment.

4.2 Access and Safety:

  • You must ensure safe and unobstructed access to the work site. If there are any safety hazards, you must inform us in advance.

4.3 Payment Terms:

  • Payment terms will be outlined in the service agreement. Late payments may incur additional charges.

5. Changes and Cancellations

5.1 Service Modifications:

  • Any changes to the scope of work must be agreed upon in writing. Additional charges may apply for any modifications or additional services.

5.2 Cancellations:

  • Cancellations must be made in writing at least 24 hours before the scheduled service. Late cancellations may incur a fee.

6. Liability and Indemnity

6.1 Limitation of Liability:

  • Our liability is limited to the value of the services provided. We are not liable for any indirect, incidental, or consequential damages.

6.2 Indemnity:

  • You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your breach of these Terms or your negligence.

7. Governing Law

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in South Africa.
